Site Use Terms
This website (‘the Site’) is provided by A Daily Bouquet (‘we’, ‘us’, ‘our’) located at www.adailybouquet.com. These terms govern access to and use of the Site by site users (‘you’, ‘your’). Use of the Site, or registration as a registered user on the Site, indicates acceptance of these terms. If you do not accept these terms, you must not use or register with the Site. We may amend these terms from time to time. Amendments take effect when the amended terms are published on the Site.
You may order products using the Site. The supply of products will be governed by our product supply terms, which are available on this page below. We may withdraw any product from sale, or change the design or specification of any product, at any time. We have no liability for errors or omissions in Site content.
The Site and its content (including text, images and code) are subject to copyright. Other trade marks and images used on the Site are the property of their respective owners. All rights in the Site, its content and those trade marks are reserved.
Product Supply Terms
These supply terms govern the supply of Products by A Daily Bouquet (‘we’, ‘us’, ‘our’) to customers (‘you’, ‘your’) who Order such Products from us.
Please read the terms carefully. Ordering Products from us indicates that you accept these terms.
We may amend these terms from time to time. Amendments take effect when the amended terms are published on our website at www.adailybouquet.com and will apply to Products purchased after that date.
Definitions
‘Business Day’ means a day which is not a Saturday, Sunday or public holiday.
‘Delivery Charge’ means the delivery charge indicated by us at the time of your Order, or if no delivery charge was indicated, then our normal delivery charge for the Products.
‘IP Rights’ is an abbreviation for ‘intellectual property rights’ and includes all copyright, patent rights, registered and unregistered trade mark rights, know-how, trade secrets and rights associated with confidential information, in any jurisdiction.
‘Order’ means your order for one or more Products using this Site, or an alternative order process accepted by us such as a telephone or email Order. Orders are not binding on us until we have accepted them.
‘Price’ means the price of the Products we indicated on the Site at the time of your Order, or if no price was indicated, then our usual price for the Products from time to time. Prices are denominated in USD and exclude Taxes. Taxes are added on separately in the checkout process. Prices are not binding until we accept an Order. We reserve the right to change Prices indicated on the Site from time to time, and to correct Prices indicated on the Site in error.
‘Products’ means the products you Order from us.
‘Site’” means the web site at www.adailybouquet.com.
‘Tax’ includes any tax, duty or charge imposed by any competent authority, including sales or value-added tax or charge on the Products or their supply.
Prices and Payment
- Prices currently include delivery.
- All prices are in United States Dollar (USD).
- Pricing excludes tax, tax is added on in the checkout page.
- We accept payments via Mastercard, Visa & AMEX via our payment gateways, Stripe & Paypal. No payment information is stored on our end.
- Prices are subject to change daily depending on flower availability and demand.
- If there is an error with pricing we have the right to cancel and refund the order.
- Payments outside of Orange County, CA will be automatically refunded. Note the merchant fees will not be refunded as this comes at our expense. Stripe and Paypal fees are 2.9% + 30c per transaction.
Orders
- To properly process your order, we need to collect a bit of information about you and the intended recipient. We need your name, contact information, billing details, billing address, delivery address and payment details.
- For information on how we obtain, store your personal information please refer to our privacy policy.
- Note no credit card information is stored on our end.
- Payment will need to be confirmed before we send your order.
- We deliver within Orange County, California only. Any order outside this area will be automatically refunded minus the merchant fee stated above in Prices and Payment.
- Our delivery hours are between 9am-6pm.
- We cannot deliver to specified times with our free delivery, however if you require a specified time a fee of $15 will be charged. Our couriers follow the most efficient route while delivering, any changes to this may delay other orders therefore a fee is required.
- If no one is home, we leave the products in a safe area and will notify you by text or email. If no where is safe for delivery we’ll call you to reschedule.
- Delivery addresses with gate codes or passwords must be entered in the special instructions area in the checkout.
- No refunds are available for incorrect delivery details or not responding in a timely matter.
- Same day delivery cut off time is 11am, Monday to Friday. We don’t deliver on weekends or public holidays.
- An Order must specify a physical delivery address (not a PO Box or freight-forwarder).
- Due to COVID-19 we cannot deliver to nursing homes or hospitals. This may change/update without notice.
- Orders are not binding on us until we accept them.
Availability of a Product
- Only one style of flowers is available each day.
- Products seen on this website or social medias are of past bouquets and are used as guides only.
- If the product is sold out for the day, no orders will be processed for that day.
Refunds, warranties & cancellations
- If an incorrect delivery address has been given, a $15 redelivering fee will occur.
- It’s the senders responsibility to make sure the correct delivery details/instructions are provided. This can be done on the checkout page or by contacting us. An additional $15 will be charged for redelivery.
- We cannot refund for same day/delivery purchases as our turn around times are very quick.
- Due to the nature of our product, each flower is different and some more delicate than others. Please expect the flowers to last for at least 3 days. Please follow our maintenance guide in the FAQs page on how to care for your bouquet. If maintenance guides are not met we cannot provide refunds.
- The same value of flowers is wrapped in every bouquet. Due to the nature of our product, sizing depends on several variables which includes flower size, availability, type, color and bloom. We cannot provide refunds or redeliver for these issues.
Events beyond a party’s control
- If a party’s performance of this agreement (other than a payment obligation) is affected or delayed by an event beyond its reasonable control, that party will not be liable to the other party to the extent its performance is affected by the event.
- The affected party must promptly notify the other party of the event and must use its reasonable endeavors to mitigate the effects of the event as soon as practicable.
Other
- If you are under 18, you must obtain your parent or guardian’s permission to place an Order, and we are entitled to assume you have done this.
- We do not represent or warrant that the Products are suitable for your specific requirements.
